DFEH Charges in California - We Got a Claim. Now What?


The first step in defending against any claim of harassment or discrimination is typically responding to a charge from the Department of Fair Employment and Housing and the Equal Employment Opportunity Commission. Preparing the Company's response is a critical event in the life of a claim as it lays the foundation for the Company's defenses that may be raised in a future civil action.

Attendees will learn:

  • Best practices in responding to DFEH charges, including how to draft a responsive position statement
  • What steps to take internally to protect your organization when faced with a charge
  • How the DFEH is handling charges and current trends within the organization.

Nicole Minkow, Pearlman, Borska & Wax


Nicole G. Minkow is Senior Employment counsel with Pearlman, Borska & Wax and Chair of the firm’s Employment Law Department. Prior to joining the firm, Nicole was Counsel with Jackson Lewis LLP, a national employment law defense firm. Nicole specializes in handling all aspects of employment defense litigation on behalf of employers and management. Nicole’s experience includes cases involving claims for wage and hour violations under state federal law, harassment, discrimination, retaliation, wrongful termination, breach of contract, defamation, fraud and unfair business practices. She also assists employers in defending against wage and hour class actions regarding alleged overtime violations, meal and break violations and minimum wage claims. Nicole has experience litigating before California’s trial and appellate courts at the state and federal level. She has also successfully argued several cases before the California Court of Appeal.





This program has been approved for 1.25 Professional Development Credits (PDCs), towards SHRM-CP and SHRM-SCP, through the Society for Human Resources Management (SHRM).

Cancellation Policy

There will be a 50% administration fee for any cancellations. If you need to cancel, we must receive it in writing (email or fax) 2 business days prior to the event during normal business hours. Refunds will not be given to no-shows. Credits will not be issued for use towards future PIHRA events.
