Why Hiring is Different in 2019

New laws in California and other jurisdictions are changing the way employers approach hiring. Information including criminal records and prior salary, which have been a staple of hiring decisions, are either restricted or can no longer be considered. We will discuss the restrictions related to what inquiries are permissible, and what inquiries are not permitted, timing of inquiries, and how hiring decisions can be made while limiting risk.

Learning Objectives
Participants will learn the following:

  1. While criminal background checks are still permitted, they should be the last inquiry and not the first.
  2. Rejecting an applicant with a criminal background must be a carefully reasoned decision.
  3. In hiring, employers must determine the value of a position, without regard to prior salary.

Robert S. Blumberg, Esq. represents and advises employers in a wide variety of labor, employment and business law matters, including the following types of litigation: Wrongful Discharge; Discrimination; Harassment Suits; Retaliation; Wage and Hour class actions; and Unfair Competition and Misappropriation of Trade Secrets.

Robert spends the majority of his time litigating matters in state and federal courts and before various administrative agencies. He has been lead counsel in both jury and bench trials and has filed briefs and appeared before the California and U.S. Courts of Appeal. He has been the lead attorney on numerous litigation matters, including class actions cases involving claims of wage and hour violations and discrimination.

A substantial portion of Robert’s practice is devoted to advising employers in the day-to-day issues of managing employee relations and discipline, background checks, and wage and hour matters. His advice practice is focused on helping employers manage potential litigation risks, so they can focus on managing their business.

Cancellation Policy

There will be a 50% administration fee for any cancellation. If you need to cancel, we must receive it in writing (email or fax) 2 business days prior to an event during normal business hours. Refunds will not be given to no-shows. Credits will not be issued for use towards future PIHRA events.
