This will be a fast-paced, informative review of hot topics and developments relating to California and federal employment laws. HR and employer representatives will gain insights regarding the current and trending issues that will enable them to reduce risks while staying abreast of laws and obligations they must address every day:
- An average of 2 – 10 wage-hour class actions are filed every day in California. Many of these cases allege similar claims where plaintiffs’ attorneys seem to have examined policies, practices, emails and the Employee Handbooks to find. HR executives should review their policies and practices, internal emails and memos to reduce risks of being targeted with wage-hour claims and -worse yet – being hit with liability.
- Claims under the Private Attorneys General Act of 2004 (“PAGA”) are at an all-time high, with over a dozen new claims filed every day. PAGA cases (nicknamed “bounty hunter cases”) present some of the greatest risks that California employers face. How can HR professionals reduce the risks of PAGA litigation?
- New rules on preemployment screening and application forms require radical changes in forms and practices, including ban-the-box, salary history, criminal history and equal pay standards. HR executives must review and update their forms and practices.
- The US Department of Labor has issued proposed changes to its exemption, joint employment and overtime pay rules in the past few months. Do not be caught off-guard when these changes are implemented.
