Are businesses’ employment practices equipped to address employees’ legal use of marijuana? Most employers have drug and alcohol policies, but how well do these policies address marijuana use? THC stays in the blood system longer than alcohol, so when an employee fails a drug test because she has THC in her system, does the failed drug test really mean that the employee is “impaired” at work? Slowly but surely, the practical implications of the legalization of marijuana have forced employers to examine their workplace policies and to determine what their companies are willing to tolerate.

Objectives:

  1. Review the potential pitfalls awaiting employers as they navigate yet another tricky workplace dilemma
  2. Explore the options that are available so that employers can properly address the ever growing use of marijuana in California.

Speaker

 

Vee B. Sotelo is the Chair of Slovak Baron Empey & Murphy, LLC’s Labor & Employment Department. Her practice includes both employment litigation as well as employment counseling. She represents employers of all sizes.

Vee attended Case Western Reserve University School of Law and graduated in 1995.

She started her career as a legal researcher throughout the US and in Italy. Subsequently, Vee settled in California and has been a practicing attorney in California since 2003. She is licensed to practice before California and federal courts.

Vee’s practice is focused on providing employer clients with day-to-day advice and counseling to keep the clients’ employment practices compliant with applicable state and federal law. When the need arises, Vee and her SBEMP Labor & Employment team will defend their clients in litigation, from trial through the appellate process.

Additionally, Vee has represented clients in all levels of administrative actions, including, but not limited to, actions before the National Labor Relations Board, the Occupational Health and Safety Administration, the federal Department of Labor, the California Division of Occupational Health and Safety, the Employment Development Department, and California Labor Commissioner.

Vee’s services to clients include day-to-day counseling regarding employment issues; preparation of employment-related documents, including employment agreements, handbooks, separation agreements, disciplinary documents, among others; defending clients in civil litigation; advising clients of developments in employment law; and reviewing clients’ employment practices to ensure compliance with applicable state and federal laws.
