Avoiding Harassment Liability in the #MeToo Era
presented by James J. McDonald, Jr.

Recent focus on sexual harassment in media, entertainment and government will likely bring a new wave of sexual harassment lawsuits against employers of all types. This presentation will take you beyond the basics and show you how to write an effective policy against harassment, how to train managers and supervisors to avoid seemingly innocent situations that often lead to harassment claims, and how to respond effectively to complaints to prevent them from becoming lawsuits. The non-deductibility of confidential settlements of harassment claims under the new tax law will be addressed too.

Learning Objectives:

  • Learn how to draft a policy against harassment that is compliant but not too broad.
  • Learn how to train managers not just to avoid harassing employees but to avoid the use of poor judgment that often leads to harassment claims.
  • Learn how to conduct an objective, effective and unbiased investigation of harassment complaints.
  • Learn how to tailor the punishment for violation of your harassment to the seriousness of the misconduct.
