Immigration in the Trump Administration: How New Executive Orders & Policies are Affecting Employers

Trends to Prepare For and How to Mitigate Exposure

The presentation will highlight the current administration’s immigration actions and policies (Buy American, Hire American) and how these are affecting employers. We will take a special look at the recently passed California legislation (AB 450 – the Immigrant Worker Protection Act) and how this law conflicts with federal laws – placing employers in a tough position – and understanding the company’s rights and obligations under the law. And we will discuss the recent ramp up by ICE on worksite enforcement, and how this is affecting employees and the work environment.

We will highlight the places where employers are exposed; how to protect and mitigate that exposure; and when to bring in counsel. The specific topics and questions addressed will include: Employment Eligibility (Who Can you Hire?); What is Next for DACA Employees; Avoiding Discrimination Based on National Origin (both during recruiting and onboarding, as well as within the corporate environment); Reverse Discrimination Claims on the Rise; I-9 Paperwork Violations and the corresponding fines and penalties; How to Mitigate I-9 violation exposure and how to handle an ICE audit; Electronic I-9 Software; E-Verify; Foreign Travel – Corporate travel
