He Said/She Said/They Said: But Who to Believe? - Investigating Workplace Misconduct


In workplace investigations, witnesses often contradict each other on key facts or witnesses interpret those facts differently. As an investigator, you must determine whose version (or interpretation) of those facts you believe. How do you make that determination? Are you confident that your approach to assessing witness credibility results in correct findings?

This presentation provides an in-depth analysis of credibility factors, including corroboration, plausibility, motivation, consistency, contradictions and demeanor. The presentation also explores other factors that may influence an investigator’s decision making process, including implicit/unconscious bias, and provides guidance to reduce those concerns. Finally, this presentation uses real world examples and fact-based hypotheticals to sharpen your skills in making credibility assessments.

1. Attendee will receive six credibility factors to analyze during the investigation process;

2. Attendees will review a video presentation and discuss relevant facts as a credibility exercise; and

3. Attendee will receive tips to develop their investigation analysis skills.

Nate Kowalski is a Partner with Atkinson, Andelson, Loya, Ruud & Romo and Chair of the firm’s Public Entity Labor and Employment Practice Group. He is an accomplished litigator who represents employers in both the private and public sectors. Arielle Spinner is an Associate with Atkinson, Andelson, Loya, Ruud & Romo and represents public and private entities in a wide variety of labor and employment matters. Her areas of expertise include federal and state discrimination, harassment, and retaliation claims, First Amendment claims, PERB unfair practice charges, and disciplinary arbitrations. Ms. Spinner also advises and assists public sector employers in complying with the Meyers-Milias-Brown Act and the Public Records Act.
