Fire Them All! Termination Horror Stories and the Lessons We Learn

It's most HR professionals’ least favorite job, and for a lot of reasons. Terminations are never easy from an operational and emotional perspective and can be a legal quagmire even when handled correctly. In this informative and interactive session, we'll review the fundamentals of sound disciplinary procedures, revisit the legal issues that any termination calls into play and learn valuable and practical steps that we should all take to make terminations go as smoothly as possible, for both the person being terminated and for the company. We'll also try to have a little fun with this topic and share some of our worst termination stories.

Learning Objectives:

  • A review of the concept of at-will employment and how it can be eroded under various doctrines that vary from state to state.
  • A review of key types of employment claims that employers want to avoid: discrimination, defamation, violation of public policy, breach of contract, etc.
  • Practical tips for managing the disciplinary process.
  • Practical tips for creating a strong case for a termination.
  • Guidance on best practices for carrying out terminations.
  • When to get employment counsel involved.
  • Steps to take if you do get sued.
