My Employee Just Switched Genders! Now What?
The rights of transgender persons have been in the spotlight of late. This presentation will begin with a discussion of what it means to be transgender and how a person may change his or her gender under California law. Next the presentation will address state and federal laws that protect the rights of transgender employees. Finally, the presentation will address management of transgender employees, including issues such as name and pronoun use, dress codes, which restroom transgender employees should use, and how to deal with privacy and safety concerns of other employees.

James McDonald Is managing partner of the Irvine office of the national labor and employment law firm of Fisher & Phillips LLP. Jim has practiced labor and employment law representing management for more than 30 years. He is author of California Employment Law: An Employer’s Guide, published by the Society for Human Resource Management in 2016, and he teaches labor and employment law in the Human Resources Management Program at the University of California, Irvine. He received his law degree cum laude from Georgetown University and he is certified as a Senior Professional in Human Resources (SPHR) by the Human Resources Certification Institute and he holds the SHRM-SCP certification from the Society of Human Resource Management.
